Trustee or Successor Trustee

A Trustee is a person who acts as a custodian for the assets held within a Trust.  They are responsible for managing and administering the finances of a Trust per the instructions given. Often, the person who created the Trust is the Trustee until they can no longer fill the role due to incapacitation or death.  At that point, a Successor Trustee takes over. The responsibilities can include recording expenses and income, distributing funds to beneficiaries, filing taxes and keeping a record of all transactions.

Executor of Estate or Probate

An executor of an estate is an individual appointed to administer the last will of a deceased person and carry out the instructions to manage the affairs. They are appointed either by the testator or a court. Executors ensure all assets in the will are accounted for and transfer these assets to the correct beneficiary.

Every trust, probate and conservatorship require the preparation of a fiduciary accounting.  I have more than 10 years’ experience with preparing court compliant accountings and Trust Accountings.

Power of Attorney for Finance

This appointment gives the agent the ability to manage your financial affairs if you become unable (or unwilling) to manage them yourself that are not held in trust.

Power of Attorney for Health Care

An Advanced Health Care Directive (also known as Power of Attorney for Health Care) allows you to appoint a healthcare agent to make healthcare decisions for you (the principal). Your agent only makes decisions for you if you have lost capacity, unless you state otherwise in the document.
